Jacksonville Probation Violation Attorney
What is Probation?
Given the fact that Florida’s inmate population is large and its jails and prisons face overcrowding, the criminal courts will lean toward probation as an alternative to incarceration whenever possible, but what is “probation” exactly? After a defendant is convicted of a crime, they may be placed on probation, a type of “supervised released.” The offender is allowed to stay in the community; however, they are closely supervised by a probation officer and they must adhere to strict conditions set by the court.
Accused of violating a condition of your probation? Contact The Law Offices of Jason K.S. Porter, P.A. to meet with a Jacksonville probation lawyer in a free, one-hour consultation.
Probation Conditions in Florida
While probation conditions vary widely from case-to-case, they often include:
- Fines
- Counseling
- Incarceration
- Community service
- Victim restitution
- Continued employment
- Weapons restrictions
- Submitting clean drug tests
- Financial support for dependents
- Restrictions on using drugs and alcohol
- Regular reporting to probation officer
- Restrictions on leaving the county or country
- Restrictions on committing new crimes
Can You Violate Probation and Not Go to Jail?
If you violate your probation and it’s reported, you’ll likely have to stand before a judge to answer for what you did. If the probation violation did not involve committing a new crime, but instead violating a condition of probation (for example, you socialized with a known criminal when the judge prohibited you from doing so), you’ll have a probation revocation hearing, which you’re entitled to receive a notice about in writing. The written notice would outline the date, time, and reason for the probation revocation hearing.
A probation revocation hearing is not a trial. It happens in court, in front of a judge. Will you go to jail? Not necessarily. It is possible to violate your probation and not be incarcerated. The outcome depends on your criminal history, the nature of the violation, if this is your first violation, if you committed a new crime, and if you have a skilled probation violation attorney by your side.
The consequences of a probation violation may involve extending the probation term, additional community service hours, revocation of the probation and serving the full original sentence. However, if you’ve been arrested for a probation violation, our goal as your criminal defense team would be to help you avoid a revocation.

I'd been accused of something I did not do. My situation was a total nightmare. I consulted with Attorney Porter and he assured me that my tough situation could be handled. Attorney Gary Shumar tirelessly worked my case, while showing patience and empathy when I felt frustrated. Needless to say, my charges were dropped. I highly recommend this firm.- Nikki

100% success rate. I used Jason Porter's services two different times for a DUI charge. The first DUI case I never lost my license and he won the case. The second time it was a little more difficult because of the circumstances but we took it to trial and it seemed like an effortless victory. Jason and his staff were very professional and helpful through the entire process.I could not have asked for anything more. Thank you so much for everything.- Jeremy T.

My experience working with Mr. Thacher was that he was incredibly knowledgeable, responsive, and took the time to explain everything to me. He took a process that I was unfamiliar with and helped me understand all my options and be able to make the best decisions in my case, and I really felt like he cared about the outcome for me. I was referred to his law office, and I highly recommend him if you're in need of a defense attorney. He will work towards the best possible outcome for your case and has a lot of experience, so you can feel confident in his advice. The phone call I received today was nothing less than thrilling! Thanks again.- D. W.

He represented me on a VOP case this year. HE, I and the prosecutor knew it was some bull basically. I was a week away from completing my 10 yrs of probation when they tried to Violate me. Mr porter told me before I even made him my lawyer that he would get this case handled in my favor and that’s exactly what he did ! And got it done in a reasonable time without me having to travel back to Florida being that I was living in NJ ! I can’t thank him enough and highly recommend him!- L.H.
